A Linn County man was jailed during the Memorial Day weekend, on accusations that he shot and killed a dog that wasn't his.
The sheriff's office says neighbors complained that Brian Lee Powell used a rifle to shoot the dog named Dakota. Powell reportedly told authorities that he thought he could shoot the dog because he lives "in the county", not in any city limits, and because the pet was on his property.
But Deputy Matt Rae told Powell that he had no such right. The 48-year-old was charged with animal abuse and unlawful use of a deadly weapons. Deputies also say alcohol was involved. Powell was briefly jailed, then bailed out.
One of Powell's neighbors defended him, saying he had lost a couple of his chickens recently, and that Dakota may have killed them.
Dakota was a Gordon Setter, a long-haired and non-aggressive breed, who belonged to a woman living nearby. Gordon Setters resemble a darker-coated version of an Irish setter. Gordon setters are often trained to retrieve water fowl. They are generally considered fairly mellow, friendly and trusting.
