David L. Bowers was arrested Tuesday [May 27, 2008] at his home in the 14600 block of North 75th Avenue, Peoria, on four counts of animal abandonment, a felony, and four counts of failure to provide medical care, according to the MCSO.
In April, David L. Bowers was taken into federal custody for civil contempt of court in the 9th Circuit U.S. District Court.
He advised the judge that he had horses and one cat at home that he would not be able to care for them while he was in custody, officials said. The judge asked if he could name anyone who would be able to care for the animals. He said there was no one and offered no assistance in finding anyone.
On four different occasions, Bowers failed to assist the court in finding someone who would help care for his animals while he was in custody, MCSO deputies said.
The suspect was in custody for 30 days and in that time never made an attempt to find alternative care for his animals, MCSO reported.
While Bowers was in federal custody one of his horses, a pregnant mare, had birth complications resulting in a stillborn foal. The mare suffered injuries and was ultimately euthanized due to a tetanus infection deemed incurable by a veterinarian. Bower's three remaining horses were cared for by David's neighbors, acted voluntarily and were never told to provide such care, officials said.
