It was an anonymous call that brought animal cruelty investigators to a backyard shed in southwest Miami-Dade County where a dog weighing about 90 pounds was found dead, its body left hanging from a rope and chain.

The dog's owner, 58-year-old Luis Batista, was arrested and charged in connection with the animal's killing, police said.

Batista keeps nearly a dozen dogs and other animals on the property that sits in an area of the county nicknamed "horse country."

"I said, 'What happened?' And he said, 'I lost it,'" said Marcie Newmark, the owner of the property where Batista's animals are housed.

Newmark said Batista snapped after learning the dog killed several geese that he had helped raise.

The viciousness of the dog's killing is hard for Newmark to accept because she's known Batista for 15 years. She described him as a wonderful, animal-loving, kind and spiritual guy who "just took in stray dogs, had geese and chickens. He took very good care of every one of his animals. He loved them."

Miami-Dade police took Batista into custody and charged him with animal cruelty, a third-degree felony that carries a penalty of up to 5 years in prison if convicted.


Case Updates

This case went before Judge Rosa Rodriguez and she did not sentence the defendant to jail time. She elected to offer him a withhold of adjudication and eleven months reporting probation. He pled guilty and accepted the offer. The sentencing took place on 5/6/2008.
