A 23-year-old Zanesville man was arrested Friday afternoon after he threw a two-month-old puppy out a two-story apartment window.

Zanesville Police Department Detective Sgt. Ric Roush said Brandon E. Smith, of 518 McIntire Ave., was arrested on one count of cruelty to a companion animal.

Roush said his officers were called to the apartment complex on a report of a domestic disturbance where a gun may have been involved.

When officers arrived, they learned Smith and his brother had gotten into an altercation and Smith threw the puppy out a window.

Smith will have a first appearance in Zanesville Municipal Court on Monday, Roush said.

Roush says the puppy is seriously injured and may not survive.

If Smith is convicted he could face up to a year in prison.

The Zanesville man who threw a puppy from a window has pleaded guilty to one count of cruelty to a companion animal.

Brandon E. Smith, 23, appeared in Zanesville Municipal Court on Monday and faces up to 180 days in jail and a fine of $1,000.

The 2-month-old puppy continues to improve after the incident that occurred on Friday, according to the local veterinarian that has been giving the puppy day and night care.

Jack, as the puppy is now called, has been cared for night and day by Dr. Mike Smith and his wife, Carolyn.

Dr. Smith initially saw Jack at his clinic, the Maysville Animal Hospital on Maysville Pike, but by Friday night, Jack was in the arms of his wife.

Jack is now eating, alert and starting to walk around and attempting to follow one of the Smith's dogs around the house. That is unless Carolyn is holding him, which she does most of the day and night.

Sustaining a major concussion and back injuries, Jack still has a problem with his sight, Dr. Smith said.

"We're not sure if he'll ever see again," he said Monday afternoon. "He doesn't blink when a light flashes at him, but he may see shadows."

Jack was in serious condition when Smith first saw him and almost died.

But Carolyn has been constantly nursing Jack - holding him, feeding him and making him feel secure.

According to Dr. Smith, Jack fell either directly on his head or on his neck.

"He's a very small puppy and very thin with little muscle mass," Dr. Smith said. "Right now he needs to be continually monitored since he is still in a delicate condition."

Dr. Smith also states that Jack will need continued care by someone who can devote most of their time to him.

"It's not much different than a newborn baby," Dr. Smith said. "Someone is going to have to be totally committed to caring for him and help him learn how to cope with not being able to see. It's going to take a great deal of dedication."

Dr. Smith did say he doesn't believe Jack will need a lot of on-going medical treatment.

"He's still scared of loud noises and fast movements and he doesn't like to be away from me right now," Carolyn said.

Zanesville Police were called to the apartment complex at 518 McIntire Ave. around 1:30 p.m. Friday on a report of a domestic dispute and a man with a gun.

When officers arrived they discovered the tiny puppy crumbled in the parking lot.

Brandon E. Smith was arrested after he admitted to officers he had thrown the puppy out a bathroom window after getting into a dispute with his brother, Jeremy.

Smith has a sentencing date of April 18.

According to Susan Small, one of the attorney's for the City of Zanesville, Judge William Joseph can sentence Smith to whatever sentence he feels appropriate.

"The sentence is completely up to the judge in this case," Small said. "My office can make recommendations, but this matter will be left in his hands. I do know the judge is taking this case very seriously."

Joseph ordered a presentence investigation prior to the sentencing, Small said.
