Incident Date: Tuesday, Mar 11, 2008
County: Duval

Disposition: Alleged

A 43-year-old Mandarin man was jailed on charges of aggravated battery and cruelty to animals after an argument Tuesday night.

The dispute broke out over a loud radio ended in a fight at 3200 Harley Road left a man unconscious and Peanut a chihuahua, critically injured after being thrown into a wall.

Mario Radilla-Bazan, 43, was jailed on $75,000 bail, with a court date set for April 2, police said.

Police said the man was partying with friends around 6 p.m. when his girlfriend came home and lowered the radio. Someone turned it back up, so she turned it off. Thats when the man threw the dog into a wall twice, leaving it motionless with blood dripping from its nose according to the police report. Back at the apartment, an 18-year-old friend apparently asked the boyfriend not to attack the animal. He was grabbed, punched and kicked, found near unconscious at the front door by police. He ended up at Shands Jacksonville with a broken jaw and other injuries, according to the police report.

The dog was taken to an emergency veterinarian in Orange Park, who diagnosed a crushed pelvis and broken hip according to the police report. The woman told the Times-Union that Peanut is being treated, but she couldnt afford the care and had to give him up.
