An accused kitten kicker appeared before the Toowoomba Magistrates Court on a charge of animal cruelty and other associated matters.
Police claim the 27-year-old man intentionally kicked the six-week-old kitten in front of a two-year-old girl who owned the cat. The kitten died at the scene. The alleged incident at a Glenvale residence arose from a domestic situation. The man has been subject to a domestic violence order since it was imposed by Toowoomba Magistrates Court in April last year, and so is not named.
In two appearances before the court, the man was not required to enter pleas to charges of wilful damage, assault (allegedly against his partner), animal cruelty and two counts of breaching a domestic violence order.
Objecting to the man's bail application, police prosecutor Sergeant Morrie Turner told the court the incident arose from a relationship breakdown and police had concerns for the wellbeing of the complainant woman and child as well as for the defendant himself.
However, the man's solicitor Simon Trewavas said his client had no previous criminal history at all, had an address outside Toowoomba at which he could stay during the remand period and would not go near the complainant. Magistrate Bruce Schemioneck said he was inclined to grant the man bail provided he abided by a range of conditions. Those conditions included residing at the address outside Toowoomba, which was provided to the court, reporting to police twice weekly and having no contact with the complainant or approaching her at any time during the remand period.
After the man agreed to abide by the conditions, Mr Schemioneck granted him bail to appear back in the same court for mention on all charges on February 26, 2008. References« Back to Search Results
