A hearing was held in Chesapeake General District Court Criminal Division on 4/25/03 pursuant to a petition by Chesapeake Animal Bureau for custody of two dogs. Additional criminal charges were heard as well.
Animal Control Officer B. J. Williamson seized a male brindle Presa Canario and a young white mix chow type puppy from the 1800 block of Woodgate Arch in Chesapeake, Virginia (23320) on April 16, 2003.
According to the officer's testimony, he first responded to the residence on Woodgate on April 11, 2003 in reference to a complaint that animals were not being fed or watered. His investigation over the next few days confirmed that the animals were not being provided food and water, other than that provided by animal control officers. Officer Williamson confiscated both animals and transported them to a veterinarian for examination. The Presa Canario was found to have sutures in its ears that were later determined to have been there for more than a year. These sutures were removed and medication dispensed for the infection that was present. The puppy was in good condition.
Natalie James, 24 of Chesapeake, Virginia was charged with failing to provide for both animals, cruelty to animals, and no rabies vaccination or license on the adult dog. Keisha Hannah (age not known) of Norfolk, Virginia was charged with failure to provide for both animals. Victor White, 39 of Jamaica, New York was charged with cruelty to animals. That charge was amended to failing to adequately provide for animals.
Natalie James was convicted of failure to provide for animals. She was fined and ordered to pay costs of court. The cruelty charge was dismissed.
Keish Hannah was convicted of failure to provide for animals. She was fined and ordered to pay costs of court. Ms. Hannah was further ordered to pay impounding fees and the veterinary bill for the puppy. Custody of the puppy which had belonged to her was awarded to Chesapeake Animal Bureau.
Victor White was convicted of failure to provide for animals. He was fined and ordered to pay costs of court. In addition, he was ordered to pay the impounding fees and veterinary bill on the Presa Canario. The dog was ordered returned to him.
