A Dec. 4 court date was set Tuesday for an 18-year-old Hemet man accused of intentionally running over and killing a dog at a mobile home park in Hemet.

Shortly after 5 p.m. Monday, Hemet police were sent to "The Park" in the 1400 block of East Menlo Avenue, according to Sgt. Nathan Miller.

Witnesses told investigators that Foxy, a year-old Pomeranian, had been "hanging out" in front of her owners' mobile home, then started across the road, said Hemet police Cpl. Jeff Dill.

A man in a white sedan waited until the dog got in front of his car, then accelerated and ran over the animal, Dill said.

A witness used a cellular telephone to snap an image of the truck and its license plate, which led police to Oscar Montalvo Jr.

Montalvo was booked on suspicion of cruelty to an animal and vandalism at the Larry D. Smith Correctional Facility, according to sheriff's booking records.

Montalvo, who was released today on $5,000 bail, is due in court next month for arraignment.

According to court records, Oscar Montalvo pled guilty to one misdemeanor count of cruelty to an animal on January 22, 2008. On March 27, 2008, the defendant was sentenced to 6 months in jail and 3 years probation. Conditions of probation included mandatory counseling and a ban from owning animals.

An 18-year-old Hemet man accused of intentionally running over and killing a Pomeranian dog pleaded not guilty Tuesday to an animal cruelty charge.

Riverside County Superior Court Judge Michael Hider ordered Oscar Montalvo back to court Jan. 8 for a felony settlement conference.

Montalvo is free on $5,000 bail.
