A Middletown couple accused twice of animal abuse avoided trial on charges related to their puppy's death.
Prosecutor Doug Atkins dropped charges against Taylor Roth, charged in June with throwing his puppy against a wall during an argument, and his wife, Alicia Roth.
The puppy broke its leg in the incident and veterinarians eventually euthanized the animal.
A judge ordered the couple to pay the puppy's medical bills, but all charges were dropped, much to the dismay of animal welfare activists.
"In the police report it says that Mr. Roth did throw the dog against the house," said Leland Gordon, executive director of the Animal Friends Humane Society. "So here we have a dog that comes in that's injured, and it seems like nothing is going to happen because of the legal system."
Alicia Roth was also charged in August with leaving her 8-year-old rottweiler locked in a cage on a hot porch while she was away in Tennessee.
That charge of animal cruelty was also dismissed, and the dog will be returned to the couple.
