An animal cruelty charge filed earlier this year against Roy Kenney II, 33, of 6811 Edie Hill Rd. SE, Uhrichsville, has been dismissed in Tuscarawas County Court.

Kenney had pleaded no contest to cruelty to animals and two counts of failing to license a dog as a result of an investigation by the county dog warden�s office in mid-February. Authorities had been called to the Kenney home by a neighbor because a dog � initially identified as Kenney�s � had frozen to death.

Assistant Dog Warden Terry Warner said both Kenney and his wife identified the beagle dog as being theirs. Rachel Kenney later said she did not see the dog and did not identify it.

At a February court appearance, Roy Kenney said the dead dog was not his. He told Judge Brad Hillyer his beagle dog, which had run away, came home and is fine. Hillyer ordered an investigation by his probation staff.

Acting Judge Michael Cochran dismissed the animal cruelty charge after reviewing information collected by probation officers. Kenney was found guilty of the two counts of failure to license a dog for two dogs he owns and was fined $100.
