On February 22, 2003 Humane Officer Kelly Seymour was sent to investigate a 6 year old doberman left outside in rain and cold for approximately five hours.  Upon investigation she learned that the owner had returned home during these five hours but never attempted to provide shelter for said animal.  Taking into consideration the extreme weather conditions, Officer Seymour decided it was in the best interest of the dog for her to take it to the Humane Society shelter.  Upon speaking to the owner of the dog, Officer Seymour discovered dog owner no longer wanted the dog.  Dog owner claimed dog was destroying her house so she threw the dog out.  Due to the fact that the dog was outside in the rain and extreme temperatures with no shelter and that there was no food or water available for the dog, Officer Seymour charged dog owner with Section 959.13 of the Ohio Revised Code.  During arraingment, dog owner pled not guilty and a pre-trial date was set for May 15, 2003.

Case Updates

At the pre trial, Ms. Besskin pled no contest to the charges. She was given a $500 dollar fine, plus reimbursement expenses to the Humane Society of Sandusky County for caring for the dog. Also she is not permitted by law to own a companion animal for the next five years.
