Police said James Fortenberry was charged with aggravated cruelty to animals after tossing a puppy from a second-floor balcony.

According to Smyrna police, Fortenberry tortured the 9-week-old beagle before tossing it to its death.

Police said Fortenberry threw the puppy in the dumpster.
