A cat was obtained by Guappone two weeks prior to the incident, when she was advertised as a "free to good home" cat. The day of the crime, Guappone's original cat, an unaltered male cat which had been assumed lost, returned home with an abcess. According to the child witness, the abuser's girlfriend was attempting to clean the wound when the tom cat resisted loudly and actively. The new unaltered female cat stressed and attacked the girlfriend, scratching her.

Guappone and company were reportedly outraged at her behavior and chased the cat around the apartment until they caught her.

The owner removed the cat from his home and put it in the trunk of the car. His girlfriend drove the car to Logtown Road bridge and stopped in the middle of the bridge. The defendant then removed the cat from the trunk of the car and threw it off the bridge into the creek below so the cat could "cool off", in front of his 10 year old daughter who was also in the car. This occurred on Thanksgiving Eve day, a very cold day with snowstorms in the afternoon and into the evening.

The incident occurred at around noon. Snow was falling and the roads became treacherous. Two volunteers ventured out late that night in an attempt to find the cat. After approximately 15 minutes, she was located on the bank of the creek, and cautiously made her way to her rescuers. Apart from still being quite damp close to her skin, with ice crystals and mud on her underside, she was fine.
