A 33-year-old township man was arrested on March 29 on charges of animal cruelty/torture after police said he threw his caged dog out a second-story apartment window and then into a creek.

St. Clair County sheriff Lt. Tim Donnellon said the incident happened about 3:15 a.m. on March 25 and was witnessed by a neighbor.

Donnellon said the neighbor went to the creek and pulled the dog's crate out of the water. He took the dog to his apartment and called police, who confiscated the dog.

Donnellon said the dog did not appear to have broken any bones and was taken to St. Clair County Humane Law Enforcement for further examination. The dog still is at the humane law-enforcement shelter.

The suspect's name has not been released pending his arraignment, which is scheduled for St. Clair County District Court.

In Michigan, animal cruelty can be a felony punishable by up to four years in prison or a misdemeanor punishable by up to 93 days in jail.

The Port Huron Township man will be charged with the felony.

A 33-year-old Port Huron Township man charged with animal cruelty has given up the rights to his Jack Russell terrier.

Daniel Dexter Darling waived his preliminary examination Tuesday in St. Clair County District Court. He was bound over to circuit court on charges of killing or torturing an animal and habitual offender second degree.

Police said on March 25 Darling threw the caged Jack Russell terrier out the window of his second-story apartment. When that didn't injure the dog, he attempted to drown it in a nearby creek, police said. A neighbor rescued the dog and turned it over to police.

Darling attempted to get the dog back a few days later from St. Clair County Humane Law Enforcement but was refused custody of the dog.

Officers tried to get Darling to relinquish rights of the dog shortly after, but he refused, said Lyle Herman, director of the county Humane Law Enforcement office.

Herman then filed a show-cause hearing in District Court to force Darling to give up the dog.

This week, Herman said, Darling voluntarily gave up ownership of the dog.

"We've already had a vet check him out, and everything is fine with the dog," Herman said.

The dog now is available for adoption.

Herman said Darling, however, will have to pay restitution to the county for boarding the dog for more than a month.

A circuit court date for the animal-cruelty charge has not yet been set, said St. Clair County Prosecutor Michael Wendling.

If convicted, Darling faces up to six years in prison. He is free on a $1,000 bond.
