It's being called a case of animal abuse: A horse found in the backyard of a Northeast home, just hours away from death.

By first glance, rescuers don't believe Flicka the horse has had food or water for the past three months. Rescuers say it was a call from concerned neighbors that ended up saving the one-year-old horse.

Her owners say the horse was sick and that's why she wasn't eating. The group that rescued the her calls it a poor excuse.

Jessie Miller with the Animal Cruelty Heartline says, "If they thought that horse was ill they should have had a vet out there doing tests and blood work, trying to figure out why it wasn't eating."

But after working all night, there is hope.

Veterinarian Dr. Josh Harvey says, "The fact that she is standing on her own is amazing, a lot of these horses once they get down they never get back up."

Case Updates

Flicka, the dehydrated and starving pony rescued last month from a home in the 12400 block of O'Malley Road in the northeastern edge of El Paso, was released to a new home Sunday, said Jessie Miller of the Animal Cruelty Heartline of El Paso, or ACHE.

The pony had been cared for by veterinarian Josh Harvey, and by the doctors and staff at Equine Sports Medicine and Surgery Frontera Division, in Sunland Park.

Flicka was rescued along with two other horses. Her former owner, Emilio Rivera, 50, and his 25-year-old son, Emilio Rivera Jr., were arrested earlier this month on cruelty-to-animals charges and were later released on $5,000 bond each.

The Animal Cruelty Heartline of El Paso has rescued another horse from a property in northeast El Paso. This second horse was taken with the owner's permission. Other animals remain on the property, but Animal Control says they appear to be healthy and have adequate food and water. El Paso police continue to investigate and say the owners could face animal cruelty charges. The first severely malnourished horse, Flicka, was removed from their property on Sunday.
