A Queens man was charged on March 2 with allowing his dog to freeze and starve to death in his squalid backyard.

Apollo, a 2-year-old mixed breed, was found dead and frozen to the ground behind 32-20 107th St. in East Elmhurst in February.

ASPCA Special Agent Paul Lai arrested Winston Mitchell, 37, and charged him with animal cruelty and failing to provide adequate shelter for Apollo. Lai went to the house on Feb. 9 after receiving a call from a neighbor of Mitchell.

A Queens man charged with allowing his dog to freeze and starve to death in his squalid backyard pleaded guilty to an animal cruelty charge.

According to court records, Winston Mitchell pleaded guilty to one misdemeanor count of animal cruelty on August 1, 2007.

He was fined $1,000.00.

The conviction stems from in incident in February, when Apollo, a 2-year-old pit bull mix, was found dead and frozen to the ground behind his home.

Winston Mitchell of 32-20 107th St. in East Elmhurst was arraigned Friday on misdemeanor charges under the state's agricultural law, which governs animal abuse, a spokeswoman for the DA said.

An ASPCA investigator found Mitchell's black and white pit bull, Apollo, tied to a leash in the yard with no food or shelter, surrounded by feces, according to a criminal complaint filed by the DA.

Mitchell allegedly told the investigator that he forgot to bring Apollo inside and that the dog had been dead for two days, according to the complaint. The dog's frozen body was emaciated, and tests revealed that the animal probably starved to death, the complaint said. Mitchell could face a year in jail and a fine of $1,000 if convicted.
