On June 19, 2006, at approximately 0925 hours, Officer Donald Davenport, Cherokee County Sheriff's Office, was dispatched to a resident dispute. On the scene, he was approached by a male who had requested the officer's presence. The male said his mother-in-law owns the land which he rents with her permission. He said Ian McCarty had moved in June 15, 2006, and had an agreement to only have his family live in the house and a few dogs in a small pen outside the house.

The written agreement stated that the family reside there and nothing else. McCarty had constructed a dog pen across his driveway to the house and a pen behind the home had approximately 100 small dogs. Comp stated he told McCarty not to construct a pen since he was only renting the property. The amount of dogs have created a disturbance to the neighbors.

After having a look at the two pens and seeing lack of food and water, Animal Control was called to the scene. While on the scene a juvenile attempted to clean up the dog pens that were housing the dogs and giving them water from�2�water filled coke bottles.

The McCarty's were cited in a prior instance at their previous residence for several (word appears to have been left out on original document) and just prior to arrival arrival the County Marshal's Office took McCarty into custody on outstanding warrants.
