Brazos County Sheriff's Office investigators on Nov 20 consulted with prosecutors about a fatal shooting of a pet miniature horse over the weekend, but so far it has not been determined if animal cruelty charges should be filed.

"We're still investigating at this point," Sheriff Chris Kirk said, explaining that deputies were instructed by the District Attorney's Office during the meeting to conduct an additional interview before determining if a crime took place.

Santi, a stallion standing 30 1/2 inches tall, was shot once on Nov 17 evening by off-duty College Station police Officer Damian Anderson at his Rosier Road property, according to the Sheriff's Office. He shot the animal - which broke loose from a neighbor's property - in order to protect his own livestock, he told investigators.

Kirk said he will rely on prosecutors to decide if the incident constituted protection of property or cruelty to animals.

Assistant District Attorney Shane Phelps, who also presides over the Brazos Animal Shelter board of directors, declined to comment on what was discussed during the meeting.

"No decision was made one way or the other," he said.
