CONVICTED: Was justice served?

Please vote on whether or not you feel the sentence in this case was appropriate for the crime. (Be sure to read the entire case and sentencing before voting.)

weak sentence = one star
strong sentence = 5 stars

more information on voting

When you vote, you are voting on whether or not the punishment fit the crime, NOT on the severity of the case itself. If you feel the sentence was very weak, you would vote 1 star. If you feel the sentence was very strong, you would vote 5 stars.

Please vote honestly and realistically. These ratings will be used a a tool for many future programs, including a "People’s Choice" of best and worst sentencing, DA and judge "report cards", and more. Try to resist the temptation to vote 1 star on every case, even if you feel that 100 years in prison isn’t enough.

Hog neglect
Wetumpka, AL (US)

Incident Date: Sunday, Apr 30, 2006
County: Elmore

Disposition: Convicted

Defendant/Suspect: Tommy A. Bailey

An Elmore County man was convicted on 22 counts of animal cruelty and fined $1,000 for each count after the Elmore County Sheriff's Department found he was mistreating several Russian boars on his property on Rifle Range Road.

Tommy Bailey was also fined $3,000 for each count for an appeal bond, according to the District Attorney's office.

Bailey appeared before District Judge Maura Culberson on Aug. 23. He was convicted of reckless endangerment for threatening a neighbor minutes before the hog case came up in Culberson's court.

"Bailey was convicted of reckless endangerment and then we went right into the hog case," said Steve Long of the DA's office.

Long said the conviction stemmed from a complaint in May that some of the hogs were running loose. He said it is not the first time the Elmore County Sheriff's Department had been called out to the location because of the animals running around. Russian boars are very aggressive and often used for protection of property or fighting with pit bulls. They are also raised for hunting.

The two deputies responding found no water or food troughs on the premises and found one hog dead and the others consuming the meat. Culberson took notice of the drought conditions in the state at that time when considering her ruling, Long said.

Bailey claimed that his hired hands were responsible for feeding the animals, but that defense was thrown out, Long said. Bailey's wife also produced a receipt from a farm store but the receipt did not prove that feed was purchased for the animals.

Bailey has since gotten rid of the animals.
